Abstract

The presentation of the responsa prudentium in Gai 1.7 does not contain any reference to ius respondendi and is arranged in order to emphasise the profile of jurisprudential controversiality. In the corresponding passage of the Imperial Institutes (Inst. 1.2.8) the mention of ius respondendi is an autonomous initiative by the compiler (most likely, Tribonianus) and the Gaian reference to the possible divergence between jurisprudential positions is completely removed: both interventions are related to the Justinian propaganda of the chrism of imperial power on the auctoritas of jurisprudential texts, which is functional to the ideology of legal certainty.
