Abstract

Pomponius’s narrative about the origin and development of law is one of the most important evidences on the problem of legal certainty in Rome. The comparison with the reflections of Cicero and Tacitus on law, on the one hand, and with the classification of Gaius on the sources of law, on the other, shows the peculiar perspective of Pomponius who represents the ius certum as a historical category that in the most ancient phase of Roman law should be identified with the leges, from royal statutes to the XII tables, based on popular vote and publicity.
