Abstract
Ulpianus, in his Commentary of edictum to the actio de effusis vel deiectis, tests the possibility of limiting the automatic criterion of joint and several liability of the inhabitores. In this sense, he individuates two possible options for achieving that purpose: a legal one (through the divisio of the apartment or its partial commodate) and a factual one (through the valorization of certain architectural elements, as indications of exclusive enjoyment of a specific portion of the dwelling).
