Abstract

A new reading is given, on a paleographic basis, of the fragments of Papyri Michigan 4145r and 4149r, whose subject matter undoubtedly concerns congiaria and pupillary tutela with reference to a provincial environment (certainly at least Judea): the papyrus text is therefore compared with Hadriani sententiae 10, 11 and 13 concerning congiaria owed in one case to from son to mother, in another case by the curator and a pupillus orphaned by his father, in a third case by the self-styled father who had unduly collected it in place of the mother provided with ius Latii. Furthermore, a Hadrianic coin depicts a congiarium granted by the emperor to a boy (or girl) accompanied by his mother. Since the paleographic chronology of P.Mich. 4145r + 4149r, established by Valeria Piano, is around the middle of the 2nd century, and the expression si vobis videtur has led to think of a speech by a public authority to a deliberative assembly, it is proposed that it is an oratio or an adlocutio by Hadrian to the senate or to an assembly on matters of rights, such as congiaria and nomination of tutors, of Roman citizens or Latin municipes settled in the provinces or in Judea, which engaged Hadrian with the repression of the Jewish revolt and the construction of Aelia Capitolina on the ruins of Jerusalem.
