Abstract

The principle of legal certainty is of paramount importance in criminal law, being linked to key constitutional guarantees such as nulla poena, equality of treatment, fair trial. This article explores the many factors that make the reality of criminal law distant from that ideal, and argues that courts should become more aware of their role in ensuring greater foreseeability, and more legal certainty, in the application of criminal provisions.
