Abstract

Legal certainty enters the horizon of constitutional law as one of the objectives that give meaning to the entire legal system. Uncertainty is the negative starting point, the problem to be solved; just as disorder is the evil to be remedied, the constitution and constitutional law should be the instruments to remedy it. The essay examines the three main instruments provided by the constitution to approach the goal of legal certainty: the separation of law and politics; the plurality of degrees of judgement and the special role of the Court of cassation; the social function of the defense of individual rights.
